প্ল্যাটফর্মে আপনার অ্যাক্সেস এবং ব্যবহার এই শর্তাবলীর সাথে আপনার সম্মতি এবং সম্মতির উপর শর্তযুক্ত। প্ল্যাটফর্ম অ্যাক্সেস বা ব্যবহার করে আপনি এই শর্তাবলী দ্বারা আবদ্ধ হতে সম্মত হন। আপনি যদি শর্তাবলীর কোনো অংশের সাথে একমত না হন, তাহলে আপনি প্ল্যাটফর্ম অ্যাক্সেস করতে পারবেন না।
প্ল্যাটফর্ম ব্যবহার করার জন্য, আপনাকে অবশ্যই:
প্ল্যাটফর্ম ব্যবহার করে, আপনি প্রতিনিধিত্ব করেন এবং ওয়ারেন্টি দেন যে আপনি উপরে তালিকাভুক্ত সমস্ত প্রয়োজনীয়তা পূরণ করেন এবং আপনি প্ল্যাটফর্মটি এমনভাবে ব্যবহার করবেন না যা কোনো আইন বা প্রবিধান লঙ্ঘন করে। মনে রাখবেন যে প্রতিনিধিত্ব করে এবং ওয়ারেন্ট করে, আপনি একটি আইনগতভাবে প্রয়োগযোগ্য প্রতিশ্রুতি করছেন।
TrainingPool পরিষেবা প্রত্যাখ্যান করতে পারে, যেকোনো ব্যবহারকারীর অ্যাকাউন্ট বন্ধ করতে পারে এবং যে কোনো সময় যোগ্যতার প্রয়োজনীয়তা পরিবর্তন করতে পারে।
আপনার তালিকাভুক্তির জন্য অর্থপ্রদান প্রক্রিয়া করার জন্য একটি বৈধ অর্থপ্রদানের পদ্ধতি প্রয়োজন৷ আপনি সম্পূর্ণ নাম, ঠিকানা, রাজ্য/জেলা, জিপ/পোস্ট কোড, দেশ, টেলিফোন নম্বর এবং একটি বৈধ অর্থপ্রদানের পদ্ধতি সহ সঠিক এবং সম্পূর্ণ বিলিং তথ্য সহ TrainingPool প্রদান করবেন। এই ধরনের অর্থপ্রদানের তথ্য জমা দেওয়ার মাধ্যমে, আপনি স্বয়ংক্রিয়ভাবে ট্রেনিংপুলকে এই ধরনের যেকোনো অর্থপ্রদানের উপকরণে আপনার অ্যাকাউন্টের মাধ্যমে সমস্ত ফি চার্জ করার অনুমোদন দেন।
কোনো কারণে স্বয়ংক্রিয় বিলিং ঘটতে ব্যর্থ হলে, TrainingPool একটি ইলেকট্রনিক চালান ইস্যু করবে যা নির্দেশ করে যে আপনাকে অবশ্যই একটি নির্দিষ্ট সময়সীমার মধ্যে, চালানে নির্দেশিত সম্পূর্ণ অর্থপ্রদান সহ ম্যানুয়ালি এগিয়ে যেতে হবে।
প্ল্যাটফর্মের কিছু অংশ সাবস্ক্রিপশনের ভিত্তিতে বিল করা হয় ("সাবস্ক্রিপশন(গুলি)")। আপনাকে পুনরাবৃত্ত এবং পর্যায়ক্রমিক ভিত্তিতে অগ্রিম বিল করা হবে ("বিলিং চক্র")। সাবস্ক্রিপশন কেনার সময় আপনি যে ধরনের সাবস্ক্রিপশন প্ল্যান নির্বাচন করেন তার উপর নির্ভর করে বিলিং সাইকেল মাসিক বা বার্ষিক ভিত্তিতে সেট করা হয়। একটি সাবস্ক্রিপশনে ন্যূনতম সংখ্যক বিলিং সাইকেল প্রযোজ্য হতে পারে।
প্রতিটি বিলিং চক্রের শেষে, আপনার সাবস্ক্রিপশন স্বয়ংক্রিয়ভাবে ঠিক একই শর্তে পুনর্নবীকরণ হবে যদি না আপনি এটি বাতিল করেন বা ট্রেনিংপুল এটি বাতিল করেন। আপনি আপনার অনলাইন অ্যাকাউন্ট সেটিংস পৃষ্ঠার মাধ্যমে অথবা কমপক্ষে 30 দিনের নোটিশ সময়কাল বিবেচনা করে TestGorilla এর গ্রাহক সহায়তা দলের সাথে যোগাযোগ করে আপনার সদস্যতা পুনর্নবীকরণ বাতিল করতে পারেন।
আপনার সদস্যতার জন্য অর্থপ্রদান প্রক্রিয়া করার জন্য একটি বৈধ অর্থপ্রদানের পদ্ধতি প্রয়োজন৷ আপনি সম্পূর্ণ নাম, ঠিকানা, রাজ্য/জেলা, জিপ/পোস্ট কোড, দেশ, টেলিফোন নম্বর এবং একটি বৈধ অর্থপ্রদানের পদ্ধতি সহ সঠিক এবং সম্পূর্ণ বিলিং তথ্য সহ TrainingPool প্রদান করবেন। এই ধরনের অর্থপ্রদানের তথ্য জমা দেওয়ার মাধ্যমে, আপনি স্বয়ংক্রিয়ভাবে ট্রেনিংপুলকে আপনার অ্যাকাউন্টের মাধ্যমে এই ধরনের যেকোন অর্থপ্রদানের উপকরণগুলিতে সমস্ত সাবস্ক্রিপশন ফি চার্জ করার জন্য অনুমোদন করেন।
কোনো কারণে স্বয়ংক্রিয় বিলিং ঘটতে ব্যর্থ হলে, TrainingPool একটি ইলেকট্রনিক চালান ইস্যু করবে যা নির্দেশ করে যে আপনাকে অবশ্যই একটি নির্দিষ্ট সময়সীমার মধ্যে, চালানে নির্দেশিত বিলিং সময়ের সাথে সম্পর্কিত সম্পূর্ণ অর্থপ্রদান সহ ম্যানুয়ালি এগিয়ে যেতে হবে।
TrainingPool, তার নিজস্ব বিবেচনার ভিত্তিতে, 'একজন বিক্রেতা হওয়ার' জন্য একটি বিনামূল্যের (একটি "বিনামূল্য" পরিকল্পনা) সাইনআপ অফার করতে পারে। বিনামূল্যের প্ল্যান ব্যবহার করার জন্য আপনাকে TrainingPool দ্বারা চার্জ করা হবে না।

TrainingPool, তার নিজস্ব বিবেচনার ভিত্তিতে এবং যে কোনো সময়ে, তালিকাভুক্তি এবং সদস্যতা ফি সংশোধন করতে পারে। যেকোনো সাবস্ক্রিপশন ফি পরিবর্তন তৎকালীন বর্তমান বিলিং চক্রের শেষে কার্যকর হবে।
TrainingPool আপনাকে সাবস্ক্রিপশন ফিতে যেকোনো পরিবর্তনের যুক্তিসঙ্গত পূর্ব নোটিশ প্রদান করবে যাতে এই ধরনের পরিবর্তনগুলি কার্যকর হওয়ার আগে আপনাকে আপনার সাবস্ক্রিপশন বন্ধ করার সুযোগ দেয়।
সাবস্ক্রিপশন ফি পরিবর্তন কার্যকর হওয়ার পরে আপনার প্ল্যাটফর্মের ক্রমাগত ব্যবহার পরিবর্তিত সাবস্ক্রিপশন ফি পরিমাণ প্রদানের জন্য আপনার চুক্তি গঠন করে।
আমাদের প্ল্যাটফর্ম আপনাকে পোস্ট করতে, লিঙ্ক করতে, সঞ্চয় করতে, শেয়ার করতে এবং অন্যথায় কিছু তথ্য, পাঠ্য, গ্রাফিক্স, ভিডিও বা অন্যান্য উপাদান ("কন্টেন্ট") উপলব্ধ করতে দেয়। আপনি প্ল্যাটফর্মে যে বিষয়বস্তু পোস্ট করেন তার বৈধতা, নির্ভরযোগ্যতা, নির্ভুলতা এবং উপযুক্ততা সহ আপনি তার জন্য দায়ী।
আপনি, প্ল্যাটফর্মে বা এর মাধ্যমে যে বিষয়বস্তু পোস্ট করেন, জমা দেন এবং প্রদর্শন করেন তার স্রষ্টা হিসেবে, উক্ত বিষয়বস্তুর উপর যেকোন এবং সমস্ত বুদ্ধিবৃত্তিক সম্পত্তির অধিকার বজায় রাখুন। একমাত্র অধিকার মালিক হিসাবে, এই অধিকারগুলি রক্ষা করার দায়িত্ব আপনার রয়েছে৷ আমরা এতদ্বারা স্বীকার করছি যে প্ল্যাটফর্মে এই বিষয়বস্তু পোস্ট করা বা প্রদর্শন করা কোনোভাবেই একটি অন্তর্নিহিত লাইসেন্স বা তৃতীয় পক্ষের পক্ষে সামগ্রী ব্যবহার করার সম্মতির পরিমাণ নয়। তাই আমরা আপনার সুস্পষ্ট লিখিত অনুমোদন ব্যতীত যেকোনো উপায়ে এই বিষয়বস্তু ব্যবহার করা থেকে বিরত থাকব।
আপনি প্রতিনিধিত্ব করেন এবং ওয়ারেন্টি দেন যে: (i) বিষয়বস্তুটি আপনার (আপনি এটির মালিক) অথবা আপনার কাছে এটি ব্যবহার করার আইনি অধিকার রয়েছে এবং (ii) প্ল্যাটফর্মে বা এর মাধ্যমে আপনার সামগ্রী পোস্ট করা ডেটা সুরক্ষা এবং গোপনীয়তা লঙ্ঘন করে না অধিকার, কপিরাইট, বা অন্যান্য বুদ্ধিবৃত্তিক সম্পত্তি অধিকার, চুক্তিভিত্তিক অধিকার বা তৃতীয় ব্যক্তির অন্য কোনো অধিকার।
আপনি শুধুমাত্র বৈধ উদ্দেশ্যে এবং TrainingPool এর প্রকৃতি ও উদ্দেশ্যের সাথে সামঞ্জস্যপূর্ণভাবে প্ল্যাটফর্মটি ব্যবহার করতে পারেন।
বেআইনি, অনিরাপদ, আপত্তিকর, বৈষম্যমূলক বা অনুপযুক্ত কোনো চাকরির জন্য আপনাকে অবশ্যই প্ল্যাটফর্ম ব্যবহার করতে হবে না।
প্ল্যাটফর্মের অননুমোদিত ব্যবহার একটি ফৌজদারি অপরাধ হতে পারে এবং/অথবা ক্ষতির জন্য দাবির জন্ম দিতে পারে।
আপনি যখন আমাদের সাথে একটি অ্যাকাউন্ট তৈরি করেন, তখন আপনাকে অবশ্যই আমাদের এমন তথ্য প্রদান করতে হবে যা সর্বদা সঠিক, সম্পূর্ণ এবং বর্তমান। এটি করতে ব্যর্থ হলে শর্তাবলীর লঙ্ঘন হয়, যার ফলে আমাদের প্ল্যাটফর্মে আপনার অ্যাকাউন্ট বন্ধ হয়ে যেতে পারে।
আপনি প্ল্যাটফর্ম অ্যাক্সেস করার জন্য যে পাসওয়ার্ড ব্যবহার করেন এবং আপনার পাসওয়ার্ডের অধীনে যেকোন ক্রিয়াকলাপ বা ক্রিয়াকলাপের জন্য, আপনার পাসওয়ার্ড আমাদের প্ল্যাটফর্ম বা তৃতীয় পক্ষের পরিষেবার সাথেই থাকুক না কেন তার সুরক্ষার জন্য আপনি দায়ী৷
আপনি কোনো তৃতীয় পক্ষের কাছে আপনার পাসওয়ার্ড প্রকাশ না করতে সম্মত হন। নিরাপত্তা লঙ্ঘন বা আপনার অ্যাকাউন্টের অননুমোদিত ব্যবহার সম্পর্কে সচেতন হওয়ার সাথে সাথে আপনাকে অবশ্যই আমাদেরকে অবহিত করতে হবে।
আপনি একটি ব্যবহারকারীর নাম হিসাবে অন্য ব্যক্তি বা সত্তার নাম ব্যবহার করতে পারবেন না বা যেটি ব্যবহারের জন্য আইনত উপলব্ধ নয়, এমন একটি নাম বা ট্রেডমার্ক যা যথাযথ অনুমোদন ছাড়াই আপনি ছাড়া অন্য ব্যক্তি বা সত্তার অধিকারের অধীন, বা এমন একটি নাম যা অন্যথায় আপত্তিকর, অশ্লীল বা অশ্লীল।
প্ল্যাটফর্ম এবং এর মূল বিষয়বস্তু (ব্যবহারকারীদের দ্বারা সরবরাহ করা সামগ্রী ব্যতীত), বৈশিষ্ট্য এবং কার্যকারিতা ট্রেনিংপুল এবং এর লাইসেন্সকারীদের একচেটিয়া সম্পত্তি এবং থাকবে। প্ল্যাটফর্মটি কপিরাইট, ট্রেডমার্ক এবং বাংলাদেশ এবং বিদেশী উভয় দেশের অন্যান্য আইন দ্বারা সুরক্ষিত। আমাদের ট্রেডমার্ক এবং ট্রেড ড্রেস ট্রেনিংপুলের পূর্ব লিখিত সম্মতি ছাড়া কোনো পণ্য বা পরিষেবার সাথে ব্যবহার করা যাবে না। আপনি সম্মত হন যে TrainingPool-এর কাছে (একত্রিত এবং বেনামী) ডেটার একচেটিয়া সম্পত্তির অধিকার থাকবে এবং এটির পরিষেবাগুলি সম্পাদন এবং উন্নত করার জন্য ব্যবহার করতে পারে৷
আমাদের প্ল্যাটফর্মে তৃতীয় পক্ষের ওয়েবসাইট বা পরিষেবাগুলির লিঙ্ক থাকতে পারে যা ট্রেনিংপুলের মালিকানাধীন বা নিয়ন্ত্রিত নয়।
TrainingPool-এর কোনো নিয়ন্ত্রণ নেই এবং কোনো তৃতীয় পক্ষের ওয়েবসাইট বা পরিষেবার বিষয়বস্তু, গোপনীয়তা নীতি বা অনুশীলনের জন্য কোনো দায়বদ্ধতা নেই। আপনি আরও স্বীকার করেন এবং সম্মত হন যে TrainingPool প্রত্যক্ষ বা পরোক্ষভাবে কোনো ক্ষতি বা ক্ষতির জন্য দায়ী বা দায়বদ্ধ হবে না বা এই ধরনের কোনো বিষয়বস্তু, পণ্য বা পরিষেবার ব্যবহার বা নির্ভরতার কারণে বা অভিযোগের কারণে এই ধরনের কোনো ওয়েবসাইট বা পরিষেবার মাধ্যমে।
আমরা দৃঢ়ভাবে আপনার পরিদর্শন করা কোনো তৃতীয় পক্ষের ওয়েবসাইট বা পরিষেবাগুলির ব্যবহারের শর্তাবলী এবং গোপনীয়তা নীতিগুলি পড়ার পরামর্শ দিই৷
আপনি স্বীকার করেন যে আপনার সম্পর্কে তথ্য এবং পোস্ট করা বিষয়বস্তু আমাদের দ্বারা সংগ্রহ করা হবে, রাখা হবে এবং ব্যবহার করা হবে আমাদের প্রাইভেসী নীতিমালা।

যদি আপনি শর্তাদি লঙ্ঘন করেন তবে সীমাবদ্ধতা ছাড়াই আমরা কোনো কারণে, পূর্ব বিজ্ঞপ্তি বা দায় ছাড়াই আপনার অ্যাকাউন্ট বন্ধ বা স্থগিত করতে পারি।
সমাপ্তির পরে, প্ল্যাটফর্ম ব্যবহার করার আপনার অধিকার অবিলম্বে বন্ধ হয়ে যাবে। আপনি যদি আপনার অ্যাকাউন্টটি বন্ধ করতে চান তবে আপনি কেবল প্ল্যাটফর্ম ব্যবহার বন্ধ করতে পারেন।
কোনো ঘটনাতেই TrainingPool, বা এর পরিচালক, কর্মচারী, অংশীদার, এজেন্ট, সরবরাহকারী, বা সহযোগীরা কোনো পরোক্ষ, আনুষঙ্গিক, বিশেষ, আনুষঙ্গিক বা শাস্তিমূলক ক্ষতির জন্য দায়ী থাকবে না, যার মধ্যে সীমাবদ্ধতা, লাভের ক্ষতি, ডেটা, ব্যবহার, সদিচ্ছা সহ , বা অন্যান্য অস্পষ্ট ক্ষতি, যার ফলে (i) আপনার অ্যাক্সেস বা ব্যবহার বা প্ল্যাটফর্ম অ্যাক্সেস বা ব্যবহার করতে অক্ষমতা; (ii) প্ল্যাটফর্মে কোনো তৃতীয় পক্ষের কোনো আচরণ বা বিষয়বস্তু; (iii) প্ল্যাটফর্ম থেকে প্রাপ্ত কোনো বিষয়বস্তু; এবং (iv) আপনার ট্রান্সমিশন বা বিষয়বস্তুর অননুমোদিত অ্যাক্সেস, ব্যবহার বা পরিবর্তন, ওয়ারেন্টি, চুক্তি, নির্যাতন (অবহেলা সহ) বা অন্য কোনো আইনি তত্ত্বের ভিত্তিতে হোক না কেন, আমাদের এই ধরনের ক্ষতির সম্ভাবনা সম্পর্কে জানানো হয়েছে বা না করা হয়েছে, এমনকি যদি এখানে উল্লিখিত একটি প্রতিকার তার অপরিহার্য উদ্দেশ্য ব্যর্থ হয়েছে পাওয়া যায়।
এই ধরনের সীমাবদ্ধতা প্রযোজ্য হবে না যদি ক্ষতিগুলি একটি ইচ্ছাকৃত কাজ বা TrainingPool বা এর ঊর্ধ্বতন ব্যবস্থাপনার পক্ষ থেকে চরম অবহেলার ফলে হয়। যে কোন ক্ষেত্রেই এই শর্তাবলীর অধীনে TrainingPool-এর সামগ্রিক দায়বদ্ধতা শেষ বিলিং সাইকেলে TrainingPool-এ আপনার দ্বারা প্রদত্ত ফিগুলির মধ্যে সীমাবদ্ধ থাকবে।
প্ল্যাটফর্মের আপনার ব্যবহার আপনার একমাত্র ঝুঁকিতে। প্ল্যাটফর্মটি "যেমন আছে" এবং "যেমন উপলব্ধ" ভিত্তিতে প্রদান করা হয়েছে৷ প্ল্যাটফর্মটি কোনো ধরনের ওয়্যারেন্টি ছাড়াই প্রদান করা হয়, তা প্রকাশ বা উহ্যই হোক না কেন, ব্যবসায়িকতার অন্তর্নিহিত ওয়ারেন্টি, একটি নির্দিষ্ট উদ্দেশ্যে ফিটনেস, অ-লঙ্ঘন, বা কর্মক্ষমতার কোর্স সহ কিন্তু সীমাবদ্ধ নয়।
TrainingPool এর অধীনস্থ সংস্থাগুলি, সহযোগী সংস্থাগুলি এবং এর লাইসেন্সদাতারা নিশ্চিত করে না যে, ক) প্ল্যাটফর্মটি নিরবচ্ছিন্নভাবে কাজ করবে, নিরাপদ বা কোনো নির্দিষ্ট সময় বা অবস্থানে উপলব্ধ থাকবে; খ) কোন ত্রুটি বা ত্রুটি সংশোধন করা হবে; গ) প্ল্যাটফর্মটি ভাইরাস বা অন্যান্য ক্ষতিকারক উপাদান মুক্ত; অথবা ঘ) প্ল্যাটফর্ম ব্যবহারের ফলাফল আপনার প্রয়োজনীয়তা পূরণ করবে।
এই শর্তাদি বাংলাদেশের আইন অনুসারে পরিচালিত হবে এবং ব্যাখ্যা করা হবে, এর আইনের বিধানের বিরোধ বিবেচনা ছাড়াই।
TrainingPool এবং আপনার মধ্যে সমস্ত বিরোধ (এই ধরনের বিবাদে তৃতীয় পক্ষ জড়িত থাকুক বা না থাকুক) একচেটিয়াভাবে বাংলাদেশের উপযুক্ত আদালতে জমা দেওয়া হবে।
এই শর্তাবলীর কোন অধিকার বা বিধান কার্যকর করতে আমাদের ব্যর্থতা সেই অধিকারগুলির মওকুফ হিসাবে বিবেচিত হবে না। যদি এই শর্তাবলীর কোন বিধান আদালত দ্বারা অবৈধ বা অপ্রয়োগযোগ্য বলে ধরা হয়, তবে এই শর্তাবলীর অবশিষ্ট বিধানগুলি কার্যকর থাকবে৷ এই শর্তাদি আমাদের প্ল্যাটফর্ম সম্পর্কিত আমাদের মধ্যে সম্পূর্ণ চুক্তি গঠন করে এবং প্ল্যাটফর্মের বিষয়ে আমাদের মধ্যে আমাদের মধ্যে থাকা যেকোনো পূর্বের চুক্তিকে বাতিল করে এবং প্রতিস্থাপন করে।
আমরা আমাদের নিজস্ব বিবেচনার ভিত্তিতে, যে কোনো সময় এই শর্তাদি পরিবর্তন বা প্রতিস্থাপন করার অধিকার সংরক্ষণ করি। যদি একটি সংশোধন বস্তুগত হয়, আমরা যেকোনো নতুন শর্ত কার্যকর হওয়ার আগে কমপক্ষে 30 দিনের নোটিশ প্রদান করার চেষ্টা করব। কোন বস্তুগত পরিবর্তন গঠন করে তা আমাদের নিজস্ব বিবেচনার ভিত্তিতে নির্ধারিত হবে।
এই সংশোধনগুলি কার্যকর হওয়ার পরে আমাদের প্ল্যাটফর্ম অ্যাক্সেস বা ব্যবহার চালিয়ে যাওয়ার মাধ্যমে, আপনি সংশোধিত শর্তাবলী দ্বারা আবদ্ধ হতে সম্মত হন। আপনি যদি নতুন শর্তাবলীতে সম্মত না হন তবে দয়া করে প্ল্যাটফর্ম ব্যবহার বন্ধ করুন৷
যদি, যে কোনো সময়ে, শর্তাবলীর কোনো বিধান বেআইনি, অবৈধ, বা কোনো বিচার বিভাগের কোনো আইনের অধীনে কোনো ক্ষেত্রে অপ্রয়োগযোগ্য হয়ে ওঠে, বাকী বিধানগুলির বৈধতা, বৈধতা বা প্রয়োগযোগ্যতা বা বৈধতা, বৈধতা বা প্রয়োগযোগ্যতা নয় অন্য কোনো এখতিয়ারের আইনের অধীনে এই ধরনের বিধান কোনোভাবে প্রভাবিত বা প্রতিবন্ধী হবে।

These Terms of Use (“Terms”, “Terms of Use”) govern your relationship between you and Training Pool (“TrainingPool”, “us”, “we”, or “our”, a Bangladeshi limited company registered with the incorporation number C175263 / 2021 in relation to the use of https://trainingpool.net website (the “Platform”) as operated by TrainingPool.
These Terms of Use are applicable to visitors, users, and others who access or use the Use.
Your access to and use of the Platform is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Platform you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Platform.
In order to use the Platform, you must:
By using the Platform, you represent and warrant that you meet all the requirements listed above, and that you won’t use the Platform in a way that violates any laws or regulations. Note that by representing and warranting, you are making a legally enforceable promise.
TrainingPool may refuse service, close accounts of any users, and change eligibility requirements at any time.
A valid payment method is required to process the payment for your enrollment. You shall provide TrainingPool with accurate and complete billing information including full name, address, state/district, zip/post code, country, telephone number, and a valid payment method. By submitting such payment information, you automatically authorize TrainingPool to charge all fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, TrainingPool will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment as indicated on invoice.
Some parts of the Platform are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing Cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. A minimum number of Billing Cycles may apply to a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or TrainingPool cancels it. You may cancel your Subscription renewal either through your online account settings page or by contacting TestGorilla’s customer support team, taking into account a notice period of at least 30 days.

You shall provide TrainingPool with accurate and complete billing information including full name, address, state/district, zip/post code, country, telephone number, and a valid payment method. By submitting such payment information, you automatically authorize TrainingPool to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, TrainingPool will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
TrainingPool may, at its sole discretion, offer a free of charge (a “Free” plan) signup to ‘become a seller’. You will not be charged by TrainingPool for using the Free plan.
At any time and without notice, TrainingPool reserves the right to (i) modify the terms of use of the Free plan offer, or (ii) cancel such Free plan offer.
TrainingPool, in its sole discretion and at any time, may modify the Enrollment and Subscription fees. Any Subscription fee change shall become effective at the end of the then-current Billing Cycle.
TrainingPool shall provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such modifications become effective.
Your continued use of the Platform after the modification of the Subscription fee comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Our Platform allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post to the Platform, including its lawfulness, reliability, accuracy, and appropriateness.
You, as the creator of the Content you post, submit, and display on or through the Platform, retain any and all intellectual property rights on said Content. As the sole right owner, you have the responsibility to protect these rights. We hereby acknowledge that the posting or displaying of this Content on the Platform does not in any way amount to an implied license or to a consent to use the Content on behalf of third parties. We will therefore abstain from using this Content in any way except with your explicit written authorization.
You represent and warrant that: (i) the Content is yours (you own it) or you possess the legal right to use it, and (ii) the posting of your Content on or through the Platform does not violate the data protection and privacy rights, copyrights, or other intellectual property rights, contractual rights or any other rights of any third person.
You may only use the Platform for lawful purposes and in a manner consistent with the nature and purpose of TrainingPool.
You must not use the Platform for any jobs which are unlawful, unsafe, offensive, discriminatory, or inappropriate.
Unauthorized use of the Platform may be a criminal offense and/or give rise to a claim for damages.
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in termination of your account on our Platform.
You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password, whether your password is with our Platform or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
The Platform and its original content (excluding Content provided by users), features, and functionality are and shall remain the exclusive property of TrainingPool and its licensors. The Platform is protected by copyright, trademark, and other laws of both Bangladesh and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TrainingPool. You agree that TrainingPool shall hold the exclusive property rights to the (aggregated and anonymized) data and may use these for performing and improving its services.
Our Platform may contain links to third-party websites or services that are not owned or controlled by TrainingPool.
TrainingPool has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that TrainingPool shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise you to read the terms of use and privacy policies of any third-party websites or services that you visit.
You acknowledge that information about you and the Content posted will be collected, held, and used by us in accordance with our Privacy Policy.

We may terminate or suspend your account, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the Platform shall immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform.
In no event shall TrainingPool, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Such limitations shall not apply if the damages are the result of a deliberate act or gross negligence on the part of TrainingPool or its senior management. In any case shall TrainingPool’s aggregate liability under these Terms be limited to the fees actually paid by you to TrainingPool in the last Billing Cycle.
Your use of the Platform is at your sole risk. The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. The Platform is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
TrainingPool its subsidiaries, affiliates, and its licensors do not warrant that a) the Platform will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Platform is free of viruses or other harmful components; or d) the results of using the Platform will meet your requirements.
These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.
All disputes between TrainingPool and you (whether or not such dispute involves a third party) shall be submitted exclusively to the competent court of law in Bangladesh.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms shall remain in effect. These Terms constitute the entire agreement between us regarding our Platform, and supersede and replace any prior agreements we might have between us regarding the Platform.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change shall be determined at our sole discretion.
By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
If, at any time, any provision of the Terms is or becomes illegal, invalid, or unenforceable in any respect under any law of any jurisdiction, neither the legality, validity, or enforceability of the remaining provisions nor the legality, validity, or enforceability of such provision under the law of any other jurisdiction shall in any way be affected or impaired.
